These Application Terms of Service (hereinafter referred to as the "Terms") constitute an agreement between you and Shijiazhuang Aoqu Technology Co., Ltd. (石家庄奥趣科技有限公司), the operator of DayDayTalk (hereinafter referred to as "we," "us," "our," or the "Platform"), regarding your use of the Platform's website, applications, and related services.
Please read these Terms carefully before registering, logging in, or using our services.
By clicking "Agree," checking a confirmation box, or otherwise accessing or using the services, you acknowledge and agree to be bound by these Terms.
If you do not agree to these Terms, please discontinue use of the services immediately.
1. Description of Services
The Platform primarily provides online one-on-one English speaking lessons and related educational services, including but not limited to:
Teacher profiles and lesson reservations, learning materials, live lessons and lesson replays, homework assignments and assessments, periodic learning progress reports, Lesson Credit recharges and order management, customer support, and other related services.
The specific features and functions available shall be subject to those actually provided by the Platform.
2. Accounts and Eligibility
1. You must provide truthful and accurate registration information and properly safeguard your account credentials and verification codes. You shall be responsible for any losses resulting from your failure to adequately protect such information.
2. You must possess full civil capacity to use the services independently. If the services are used by a minor student, consent must be obtained from the minor's parent or legal guardian, who shall manage the account on the minor's behalf.
3. You are prohibited from renting, lending, or transferring your account to others, or using your account to engage in any illegal activities or violations of applicable rules and regulations.
3. Lesson Credits, Orders, and Refunds
Lesson Credits or Points obtained through account recharges or purchases may only be used to redeem course services within the Platform in accordance with its applicable rules.
Such Lesson Credits or Points do not constitute currency and, in principle, may not be transferred, inherited, or redeemed for cash.
Course validity periods, reservation rules, cancellation policies, and refund conditions shall be governed by the information displayed on the purchase page, order page, and the course purchase or recharge agreement in effect at the relevant time.
Summary of Refund Policy:
Users may request a refund within thirty (30) days after purchasing a course, provided that no Lesson Credits have been used. A processing fee of ten percent (10%) shall be deducted from the refund amount.
After thirty (30) days from the date of purchase, refunds shall not be granted for reasons unrelated to the Platform.
4. User Conduct
You agree to use the Platform lawfully and in good faith. You shall not engage in any of the following activities:
1. Disrupting teaching activities, insulting, harassing, or otherwise mistreating teachers or other users.
2. Distributing or publishing illegal, infringing, or inappropriate content.
3. Attacking, gaining unauthorized access to, or compromising the Platform's systems or data security.
4. Using automated or technical methods to register accounts in bulk, manipulate lesson usage records, fraudulently obtain promotional benefits, or engage in other forms of cheating or abuse.
5. Engaging in any other activities that violate applicable laws, regulations, or these Terms.
In the event of a violation, we reserve the right to take appropriate measures depending on the nature and severity of the violation, including issuing warnings, restricting certain features, suspending services, or terminating access to the Platform.
We also reserve the right to pursue applicable legal remedies and hold responsible parties legally accountable.
5. Intellectual Property Rights
All intellectual property rights relating to the Platform, including but not limited to trademarks, user interfaces, software, teaching materials, course content, and report templates, belong to us or the respective lawful rights holders.
Without prior written authorization, you may not reproduce, distribute, modify, sell, or otherwise use such materials or content.
6. Disclaimers and Limitation of Liability
To the extent permitted by applicable law, we shall be exempt from liability within reasonable limits for service interruptions or data losses resulting from force majeure events, network failures, abnormalities in third-party services, issues with your own devices, user operation errors, or other similar circumstances.
Our commitments regarding the services shall be governed by these Terms and the information publicly displayed on the Platform.
We do not guarantee that the services will be uninterrupted at all times or that they will fully meet your specific expectations or requirements.
7. Changes to Terms and Termination
We may revise these Terms from time to time in response to business requirements or applicable legal obligations.
Any revised Terms will be published on this page or within the Platform. We will provide notice of material changes through reasonable means.
Your continued use of the services following such revisions shall constitute acceptance of the updated Terms.
You may discontinue use of the services at any time.
We may also suspend or terminate the provision of services to you in accordance with these Terms or applicable laws and regulations.
8. Governing Law and Dispute Resolution
The formation, validity, interpretation, and resolution of disputes arising from or relating to these Terms shall be governed by the laws of the People's Republic of China, excluding its conflict-of-laws rules.
If a dispute cannot be resolved through mutual consultation, it shall be submitted to a People's Court of competent jurisdiction in the place where the Platform's operating entity is domiciled.
